What is Mediation?

In mediation, a neutral and impartial legal professional helps conflicting parties negotiate an agreement or a case. This person, referred to as the mediator, is mutually selected by both parties, and does not interfere with the decision-making process or take sides. Instead, the mediator helps both parties negotiate with one another by outlining major issues at hand, encouraging effective communication, and guiding the resolution process. This way, the decision-making power is solely between the involved clients.

Why Mediation?

Mediation is a form of alternative dispute resolution, and in some cases, clients may prefer this to traditional litigation. Some benefits of mediation include:

●        Greater autonomy: Clients negotiate their own agreements and have more control throughout the process, as no settlements are imposed on either party. At the same time, they still have support from an experienced legal professional to facilitate communication and conflict resolution.

●        Confidentiality: Clients can negotiate in the privacy of a mediation practice rather than in public courtrooms, and unless agreed otherwise, all information being discussed with the Mediator will be kept confidential.

●        Convenience and cost: Mediation is often more affordable than traditional court litigation, and the costs are generally more predictable. Additionally, people can often resolve conflicts quicker through mediation as it can be used in the early stages of disputes.

●        Maintaining healthy relationships: Mediators help both parties communicate effectively and respectfully, which can help prevent emotionally driven or hurtful comments. This can help preserve a healthy relationship between the parties.
